Subject: 10118/1994-114 ABB Combustion Date: Mon, 27 Feb 1989 12:20:00 -0500 1994-114 ABB/Combustion ORDINANCE NO. 10118 AN ORDINANCE CLOSING AND ABANDONING STREETS AND ALLEYS LOCATED GENERALLY BETWEEN WEST 19TH STREET AND WEST 12TH STREET, AND BETWEEN RIVERFRONT PARKWAY AND THE TENNESSEE RIVER, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned streets and alleys located generally between West 19th Street and West 12th Street, and between Riverfront Parkway and the Tennessee River, more particularly described herein, and as shown on plat attached hereto and made a part hereof by refer- ence: All of West 18th (Aiken) Street, West 16th (Louisa) Street, West Main Street (Montgomery Avenue), West 14th (Frank) Street, Hooke Street, West 12th (Cravens) Street, Sycamore Street, Ash Street, Elm Street, Short Street, Water Street, all alleyways, and any other streets, alleyways or rights-of-way with the exception of West 19th Street and any railroad rights-of-way which are located on property owned by Combustion Engineering, C-E Tube Mill, Inc., and ADM Holdings, Inc. between Riverfront Parkway and the Tennessee River. For the location of said streets and alleys, refer to the South Chattanooga Land Company Addition to Chattanooga, as shown by plat of record in plat book 4, page 45, ROHC, and Roane Iron Company's amended Addition, as shown by plat of record in plat book 2, page 37, ROHC. Tax Map No. 145B-A-4, 145G-A-2, 2.1, 3, and 4, and 145J-A-4. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The reservation for the Tennessee-American Water Company of an easement the width of the right-of-way for the purpose of operating and maintaining their facilities located within the right-of-way. 2. The City of Chattanooga has a sewer located within said right-of-way and reserves an easement the width of the right-of-way for the purpose of maintaining said sewer. 3. Reservation of an easement the width of the right-of-way for South Central Bell for the purpose of operating and maintaining its facilities in said right-of-way. 4. The areas reserved for utility easements must be kept free and clear of all structures. 5. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
